1. Service Description

Welcome to xeranthemumf, operated by xeranthemumf. Our platform provides users with access to a variety of travel-related services, including but not limited to booking accommodations, arranging transportation, and offering travel packages tailored to individual preferences. By accessing or using our services, you agree to comply with and be bound by these Terms of Service.

These Terms govern your access to and use of our website and services. If you do not agree to these Terms, you must not use our services. We reserve the right to modify these Terms at any time, and your continued use of the services following any changes constitutes your acceptance of the new Terms.

Our services are intended for users who are at least 18 years of age. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. User Accounts

To access certain features of our services, you may be required to create a user account. When creating an account, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify xeranthemumf immediately of any unauthorized use of your account or any other breach of security. xeranthemumf will not be liable for any loss or damage arising from your failure to comply with this obligation. We reserve the right to suspend or terminate your account at our discretion, without notice, if we suspect any violation of these Terms.

By creating an account, you consent to receive communications from us electronically. We will communicate with you by email or by posting notices on our website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically will satisfy any legal requirement that such communications be in writing.

3. Acceptable Use Policy

4. Prohibited Activities

In addition to the Acceptable Use Policy, you are expressly prohibited from engaging in the following activities while using xeranthemumf:

Using the services for any fraudulent or deceptive purpose.
Transmitting any viruses, worms, malware, or any other harmful code.
Collecting or harvesting any personally identifiable information from other users without their express consent.

All content, features, and functionality on xeranthemumf, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the exclusive property of xeranthemumf or its licensors and are protected by Slovak and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the services for personal, non-commercial purposes. This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

Any unauthorized use terminates the permission or license granted by xeranthemumf. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our site, except as follows: your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

6. User-Generated Content

Users may have the opportunity to submit, post, or otherwise share content on or through the services ("User-Generated Content"). By submitting User-Generated Content, you grant xeranthemumf a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or control all rights to the User-Generated Content you submit and that the User-Generated Content is accurate, not confidential, and not in violation of any contractual restrictions or other third-party rights. xeranthemumf takes no responsibility and assumes no liability for any User-Generated Content submitted by you or any third party.

We reserve the right to remove or edit any User-Generated Content for any reason, including but not limited to violations of these Terms, or if we believe that such content is objectionable or otherwise inappropriate.

7. Payment Terms

All payments for services provided through xeranthemumf must be made in accordance with the payment terms specified at the time of purchase. By providing your payment information, you represent and warrant that you are authorized to use the payment method you provide and that you authorize xeranthemumf to charge your payment method for the total amount of your purchase.

All fees are non-refundable unless otherwise stated in the service description or required by law. xeranthemumf reserves the right to change its pricing at any time, but any changes will not affect orders that have already been confirmed.

In the event of a payment dispute, you agree to contact us directly at [email protected] before initiating any chargeback or dispute with your payment provider. We will work with you to resolve any issues in a timely manner.

8. Service Modifications

xeranthemumf reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that xeranthemumf will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

We may also impose limits on certain features and services or restrict your access to parts or all of the services without notice or liability. Any new features or tools that are added to the current services shall also be subject to these Terms.

It is your responsibility to review these Terms periodically for changes. Your continued use of the services after any modifications to the Terms will constitute your acceptance of the modified Terms.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall xeranthemumf, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of, or inability to access or use, the services;
Any conduct or content of any third party on the services;
Any content obtained from the services; and
Unauthorized access, use, or alteration of your transmissions or content.

In no event shall xeranthemumf’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services.

10. Termination

These Terms are effective until terminated by either you or xeranthemumf. You may terminate these Terms at any time by discontinuing your use of the services and destroying all materials obtained from the services. xeranthemumf may terminate these Terms at any time, without notice, if you fail to comply with any provision of these Terms.

Upon termination, your right to use the services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination of these Terms does not affect any rights or obligations that have accrued prior to the date of termination.
